Terms of Service

1. Who we are, and who sells to you

1.1 LandingMatch ("Service") is operated by [KFT LEGAL NAME], a limited liability company (korlátolt felelősségű társaság) registered in Hungary, seat: [ADDRESS], company reg. no.: [CG. NUMBER], EU VAT: [VAT], email: [hello@DOMAIN] ("Provider", "we").

1.2 Merchant of record. Purchases are processed under Stripe's Managed Payments program: your purchase contract for the paid product is concluded with Stripe (acting through its relevant contracting entity) as the merchant of record. Stripe charges you, issues your invoice/receipt, and calculates and remits applicable VAT/sales tax. These Terms govern your use of the Service provided by the Provider; Stripe's own purchase terms, presented at checkout, govern the sale. Where these Terms and Stripe's purchase terms conflict regarding payment, tax, invoicing, refunds, or chargebacks, Stripe's purchase terms prevail for those topics.

2. The Service — what it is and is not

2.1 The Service monitors ads that an advertiser runs, using public ad transparency archives (Meta Ad Library, Google Ads Transparency Center), performs passive read-only checks of the public landing pages those ads link to, and produces observational reports ("Ad Spend Leak Report").

2.2 The Service reports public activity signals only (observed live ads, active status, first/last seen). It does not measure ad spend, does not access any ad account, and its outputs are risk signals and observations, not marketing or legal advice, not an audit, and not a statement that any law or platform policy is or is not complied with. 2.3 You remain solely responsible for decisions you take based on reports (including pausing campaigns or editing pages).

3. Account, eligibility, B2B character

3.1 The Service is a business tool intended for business customers (advertisers, agencies). By creating an account you declare that you act for purposes relating to your trade, business, craft, or profession.

3.2 Whether you are a consumer is determined by the actual purpose of your purchase, not by the declaration in 3.1 alone. If you purchase as a consumer, statutory consumer rights apply in full, nothing in these Terms limits rights that cannot be limited by law, and the withdrawal rules of the Refund & Cancellation Policy below apply.

3.3 You must provide accurate account data and keep credentials secure; accounts are for one organization; agency plans cover the advertiser count of the purchased plan.

4. Plans, ordering, price

4.1 Current plans: LEAK SNAPSHOT (one-time), LEAK MONITOR (monthly), AGENCY PORTFOLIO (monthly) — features and prices as shown at checkout. Prices are shown by Stripe at checkout including applicable taxes where required.

4.2 Ordering: hosted Stripe Checkout; subscription management and payment methods: hosted Stripe customer portal. We never receive or store your card data.

4.3 We may change plan prices or features prospectively; for subscriptions, changes take effect at the next renewal with at least [30] days' notice.

5. Term, renewal, cancellation

5.1 Subscriptions renew automatically each billing period until cancelled. You can cancel anytime in the customer portal; cancellation takes effect at the end of the current period (no partial-period refunds except as stated in the Refund Policy or required by law).

5.2 We may suspend or terminate accounts for material breach (incl. §7 Acceptable Use), unpaid invoices after dunning, or where required by law; where reasonable, we will warn you first.

6. Customer inputs and permissions

6.1 When you link an advertiser (e.g. paste a Meta Ad Library page URL or Google advertiser URL), you confirm you are that advertiser or are authorized by it (e.g. its agency) to obtain reports about it.

6.2 You must not use the Service to obtain reports about third parties you have no authorization for, or to harass, defame, or unfairly target any business.

7. Acceptable use

You must not: (a) resell or white-label reports except as your plan allows (agency plan: logo-on-report per plan features); (b) present reports as a legal assessment, audit opinion, or platform-endorsed evaluation; (c) attempt to make the scanner act outside its published Scanning Policy; (d) reverse engineer, scrape, or overload the Service; (e) use outputs to train competing automated scanning products.

8. Intellectual property

8.1 The Service, its software, templates, and report formats are the Provider's IP. You receive a non-exclusive, non-transferable license to use reports generated for you for your internal business purposes (agency plans: including sharing with the specific client the report concerns).

8.2 Underlying public archive data is not claimed as our property; platform names are their owners' trademarks; no affiliation with, or endorsement by, Meta, Google, or Stripe is implied.

9. Availability; changes to the Service

Reasonable efforts service: target availability [99%] monthly, excluding maintenance and third-party outages (archives, hosting, payment). Sources may change or restrict access (see §2.1 of the Scanning Policy); we may adapt or substitute data sources, and where a source becomes unavailable we will inform affected subscribers; sustained material loss of core functionality entitles you to terminate and receive a pro-rata refund of prepaid, undelivered periods via Stripe. Neither party is liable for delay or failure caused by events beyond its reasonable control (force majeure); statutory consumer rights are unaffected.

10. Warranties and disclaimers

10.1 The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 We make no promise as to: completeness/accuracy of third-party archive data; reproducibility of point-in-time checks; model-assisted match verdicts; or any business outcome (conversion, savings, platform standing) from using reports.

11. Liability

11.1 To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service in any 12-month period is limited to the amounts paid for the Service in that period, and neither party is liable for indirect, incidental, consequential damages, lost profits, or lost data.

11.2 Nothing limits or excludes liability for breach caused intentionally, or harming human life, physical integrity or health (these limitations are void under HU Ptk. 6:152. §), for gross negligence where the law applicable to you does not permit its limitation, or for any other liability that cannot be limited or excluded by law. If you are a consumer, the cap in 11.1 applies only to the extent permitted by the mandatory consumer-protection law of your habitual residence, and your statutory conformity remedies (Directive (EU) 2019/770) are unaffected.

11.3 You will indemnify us against third-party claims arising from your breach of §6 (unauthorized targeting) or §7.

12. Data protection

Our processing of personal data is described in the Privacy Policy. For payment data, Stripe as merchant of record is an independent controller — see Stripe's privacy policy at checkout.

13. Governing law; disputes

13.1 These Terms are governed by Hungarian law, excluding its conflict-of-law rules; the UN CISG does not apply.

13.2 B2B disputes: exclusive jurisdiction of the Hungarian courts competent for the Provider's seat. Consumers: mandatory jurisdiction and protective rules of their habitual residence (Brussels Ia Regulation Art. 17–19; Rome I Art. 6) remain unaffected; EU consumers may also use the applicable national ADR/consumer bodies (HU: the competent békéltető testület — [NAME, ADDRESS AND CONTACT OF THE COMPETENT BODY]).

14. Changes to these Terms

We may amend these Terms prospectively; material changes are announced at least [30] days in advance by email/dashboard; continued use after the effective date is acceptance. If you object, you may cancel per §5.


Refund & Cancellation Policy

1. Who refunds

Purchases are sold by Stripe as merchant of record; refunds and payment disputes are executed through Stripe's process. You can start any request via [support@DOMAIN] or the customer portal — we coordinate with Stripe; the outcome is delivered by Stripe to your payment method.

2. 14-day policy (all customers)

Within 14 days of first purchase of a plan, if the Service has not delivered what it promises for your account (e.g. your linked advertiser could not be scanned), we will support a full refund via Stripe.

3. EU/UK consumers — statutory withdrawal

If you purchase as a consumer, you have a 14-day right of withdrawal (Directive 2011/83/EU; HU 45/2014. (II. 26.) Korm. r.; UK CCRs 2013), exercisable free-form or via the model form, against the seller of record through the process in point 1. Two tracks apply:

Consumers' statutory rights (incl. conformity remedies under Directive (EU) 2019/770) are unaffected.

4. Subscriptions

Cancel anytime in the portal → active until period end; no further charges. Dunning: after repeated failed payments the subscription lapses.

5. Chargebacks

Handled in Stripe's merchant-of-record dispute process; please contact support first — most issues resolve faster that way.
